By accessing or using our app, you agree to be bound by these Terms of Service (“Terms”). If you disagree, please refrain from using our services.

1. About TruckRoute.AI

TruckRoute.AI provides navigation tools, alerts, and road intelligence tailored for commercial truck drivers in the United States and Canada.

2. Eligibility

You must be at least 18 years old and legally able to operate a commercial vehicle in your jurisdiction to use the app.

3. Your Use of the Service

You agree to use the app only for lawful purposes and by these Terms. You may not:

– Use the service in a way that violates any law or regulation.
– Copy, modify, or distribute any part of the service without permission.
– Attempt to gain unauthorized access to our systems.

4. Account Registration

Some features may require creating an account. You are responsible for keeping your login credentials secure. You agree to provide accurate and complete information.

5. Subscription and Auto-Renewal

TruckRoute.AI may offer both free and paid subscription plans.
If you choose a paid plan, charges will be processed through your platform (e.g., App Store, Google Play) and will automatically renew unless canceled at least 24 hours before the current billing period ends.

You can manage or cancel your subscription in your device’s account settings.
By purchasing a subscription, you agree to the pricing, billing cycle, and renewal terms presented at checkout.

6. Data and Privacy

By using the app, you agree to our Privacy Policy, which explains how we collect, use, and protect your data.

7. Intellectual Property

All content, trademarks, logos, and technology in the app are owned by TruckRoute.AI or licensed to us. You may not use them without permission.

8. Service Availability

We strive to keep our service running smoothly, but we do not guarantee uninterrupted access. Features may change or be discontinued at any time.

9. Limitation of Liability

TruckRoute.AI is provided “as is.” We are not liable for any damages or losses related to your use of the app, including errors in navigation, delays, or third-party services.

10. Indemnification

You agree to indemnify and hold harmless TruckRoute.AI and its team from any claims, damages, or liabilities arising out of your use of the service or violation of these Terms.

11. Consumer Rights – California Residents

If you are a California resident, you have certain rights under the California Consumer Privacy Act (CCPA) and California Civil Code § 1789.3, including the right to:

– Opt out of the sale of personal data
– Cancel a subscription and request a refund by applicable laws

– Ontario, Canada (for users in Canada)

Disputes will be resolved in the appropriate court within those jurisdictions.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date. Continued use of the app means you accept any changes.

14. User-Generated Content

TruckRoute.AI may allow you to upload, submit, or share content, including permits, photos, routing notes, or other materials (“User Content”).
By submitting User Content, you agree that:

– You own or have the right to upload this content.
– You grant TruckRoute.AI a non-exclusive, worldwide, royalty-free license to store, process, display, and use your content to operate and improve the service.
– You will not upload content that is illegal, misleading, harmful, or violates the rights of others.
– We may remove or restrict any content at our discretion.

You remain solely responsible for all User Content you provide.

15. Safety Disclaimer

TruckRoute.AI is a supplemental tool and must not replace professional judgment or official road signs.
You acknowledge and agree that:

– You are fully responsible for operating your vehicle safely.
– You must obey all traffic laws, signage, restrictions, and regulatory requirements.
– Navigation results may be incomplete, inaccurate, or outdated.
– You should never interact with the app while driving unless permitted by law and safe to do so.

TruckRoute.AI is not responsible for accidents, penalties, or damages resulting from reliance on the app.

16. AI Features Disclaimer

TruckRoute.AI may use automated systems, AI, or machine learning to process photos, permits, routing data, or suggest routes.
You acknowledge that:

– AI-generated outputs may contain errors or omissions.
– Automated permit extraction does not substitute for manual review.
– You must verify all permit details, measurements, and routing requirements.
– AI results are provided “as is” without guarantees of accuracy or compliance.

You remain fully responsible for confirming accuracy before operating your vehicle.

17. Refunds Disclaimer

Refunds, where applicable, are processed solely through the App Store or Google Play according to their policies.
TruckRoute.AI:

– Does not issue direct refunds
– Cannot override Apple or Google refund decisions
– Does not provide refunds for partial subscription periods, unused time, or user error

For refunds, please refer to your platform provider.

18. Termination

We reserve the right to suspend or terminate your access to the app if:

– You violate these Terms
– You misuse the service
– Fraud or suspicious activity is detected
– Required by law or regulatory authorities

Upon termination:

– Your right to use the service ends immediately
– Certain clauses (including liability limits, indemnification, and dispute resolution) will continue to apply

19. Third-Party Data and Services

TruckRoute.AI may rely on third-party data providers, APIs, mapping systems, and government or public databases.
We do not guarantee the availability, accuracy, or completeness of data provided by third-party services.
We are not responsible for:

– Outages or inaccuracies from external sources
– Regulatory changes or delayed updates
– Changes in third-party service availability

Your use of third-party services may be subject to their terms.

20. Oversize Permit Uploads and Documentation

TruckRoute.AI may allow users to upload, store, or photograph permits issued by the DOT, state agencies, provincial authorities, or other regulatory bodies (“Oversize Permits”).

By using this feature, you acknowledge and agree that:

– You are solely responsible for ensuring the accuracy, validity, and completeness of any permits you upload.
– TruckRoute.AI does not verify, validate, review, or certify any permits.
– Uploading a permit into the app does not guarantee compliance with state, federal, or provincial regulations.
– The app does not issue permits and is not affiliated with any DOT authority.

You remain fully responsible for carrying any legally required physical or digital permit copies as mandated by law.

21. No Regulatory Advice or Compliance Guarantee

The Oversize Permits feature is provided solely for organizational and convenience purposes.

TruckRoute.AI:

– Does not provide legal, safety, or regulatory advice
– Does not guarantee compliance with U.S. DOT, FMCSA, state oversize/overweight laws, or Canadian provincial regulations
– Is not responsible for penalties, citations, violations, or delays resulting from missing, invalid, expired, or incorrect permits

You must review and comply with all applicable oversize/overweight rules in every jurisdiction you operate in.

22. Oversize Routing Disclaimer

If oversize routing, alerts, or restrictions are provided, they are based on third-party or user-generated data and may not be complete, accurate, or up to date.

You agree that:

– Official road signs, pilot car requirements, curfews, lane restrictions, and local regulations always override the app
– You must follow all state and provincial oversize rules regardless of any route displayed in the app
– TruckRoute.AI is not liable for any damages, delays, or enforcement actions caused by errors in oversize routing or missing restrictions

23. Arbitration Agreement and Class Action Waiver

To the fullest extent permitted by law, you agree that any dispute with TruckRoute.AI will be resolved through binding arbitration, not in court.
You also agree that:

– You waive the right to a trial by jury
– You waive the right to participate in a class action, class arbitration, or representative action
– All claims must be brought individually

This section does not apply where prohibited by law (including certain Canadian provinces).
